The Services BikerGeo may change from time to time without prior notice to you and may stop providing the Services to you without prior notice.
The Services may include advertisements, which may be targeted to the Content or information on the Services, or other information and you agree that BikerGeo and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services regardless of party that has submitted.
You acknowledge that all Content accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. The term "Content" includes, without limitation, any location information, comments, information, data, text, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible to BikerGeo and it’s owners on or through the Services.
You retain your rights to any Content you submit or provide through the Services. By submitting or providing Content on or through the Services, you grant BikerGeo and it’s owners a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).
By submitting Content to BikerGeo or otherwise through the Service, you hereby do and shall grant BikerGeo and it’s owners a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the content you’ve submitted either directly or indirectly in connection with the Services, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds). You also hereby do and shall grant each user of the Services a non-exclusive license to access Content you’ve provided either directly or indirectly through the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and in turn submit this content through the Services.
You represent and warrant that you have all rights to grant such license to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.
You understand that all information publicly posted or privately transmitted through the Services is the sole responsibility of the person from which such Content originated; that BikerGeo and it’s owners will not be liable for any errors or omissions in any Content; and that BikerGeo and it’s owners cannot guarantee the identity of any other users with whom you may interact in the course of using the Service.
Understand that any removed user submitted content may persist in backup copies for a reasonable period of time (but following removal will not be shared with others).
BikerGeo, it’s owners or or other companies, organizations or individuals who partner with us may use Content you’ve submitted with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.
BikerGeo and its owners respect the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.
We reserve the right to remove any Content or terminate a user account without prior notice and at our own discretion.
Your access to and use of the Services or any Content is at your own risk. You understand and agree that the Services is provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, BIKERGEO, ITS OWNERS AND ITS PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Services or any content thereon and we willl not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services, or any Content. You also agree that BikerGeo and BikerGeo Owners have no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from BikerGeo, BikerGeo Owners or through the Services, will create any warranty not expressly made herein.
IN NO EVENT SHALL BIKERGEO, NOR ITS OWNERS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICE OR ADD-TO LINK (I) FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), (II) FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE (REGARDLESS OF THE SOURCE OF ORIGINATION), OR (III) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) ONE-HUNDRED U.S. DOLLARS ($100.00). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
